Heirs’ property is a legal status that occurs when family land is passed down through generations and owned by many heirs with an undivided interest in the property. 为什么这很重要? 因为在过去的一百年里， heirs’ property has driven low-income people, and especially Black and 土著 farmers, 离开他们的家庭农场, 尤其是在卡罗来纳.

Current North Carolina law on heirs’ property puts landowners at risk of involuntarily losing their land if just one of the co-owners chooses to force the sale of jointly-held family land at auction. Studies show these forced sales usually result in a price significantly below market value. 更糟糕的是, North Carolina farms in heirs’ property are not eligible for federal conservation and disaster relief funds. John Pollock of the Heirs Property Retention Coalition calls heirs’ property “the worst problem no one’s ever heard of.”
的 bipartisan Uniform Partition of Heirs’ Property Act (HB 367) would help farmers keep their land and ensure access to federal programs.
的 legislation would ensure farms in heirs’ property qualify for USDA conservation and disaster relief programs, and provide due process protections for family landowners when one co-tenant files to sell the property.
